He detailed the complexities and inconsistencies of the law, and the apparent predilection of authorities to intimidate and harass vulnerable targets, rather than focusing on the issues of United States law that remain unresolved.

INTERNET LAW – The U.S. Congress passed an anti-internet gambling legislation bill on September 30th 2006, which is known as the Unlawful Internet Gambling Enforcement Act (UIGEA).  The UIGEA signed by President Bush has caught the internet gambling industry by surprise and it is quite visible from the mixed reactions of the U.S. and European internet gambling sites. Some of the online gambling casinos have started planning regarding the implementation of this law while others are planning to shut down their operations in the U.S. Shutting down operations would lead to the collapse of the US$12 billion industry.

The Unlawful Internet Gambling Enforcement Act (UIGEA) is not here to make internet gambling illegal but what it really does is ban American poker players from using U.S. financial institutions to fulfill their online gambling needs. According to the UIGEA, American players will not be able to use U.S. bank checks, wire transfers, or credit cards, to deposit or withdraw money from the internet gambling sites.  Banking institutions have been advised to monitor all transactions related to online casinos and the process has to be in compliance with U.S. Federal Reserve and Department of Treasury legislation.

The bill has been received with open arms by the financial institutions who perceive it as a protective armor for their financial services.  At the same time, many financial institutions have also voiced their concern over the extra burden of auditing in regard to the blocking of millions of transactions. Although, financial institutions have not been able to yet assess the amount of burden and are waiting for the completion of enforcement provisions.

The original anti-internet gambling act that was presented in the House is the H.R. 4111 but it has been combined with another anti-internet gambling bill, the H.R. 4777, called Internet Gambling Prohibition Act to form the UIGEA.
